This Merchant Privacy Policy (“Policy”) describes how Skynet LLC. (“Skynet,” “we,” “us,” or “our”) collects, uses, and shares the Personal Information of merchants, partners, staff, and other individuals who use our Services (collectively, “Users” or “you“).

By accessing or using the Services, you consent to the collection, use, and disclosure of your Personal Information as described in this Policy. This Policy does not cover the data of your end customers; that data is addressed in our separate Consumer Privacy Policy and Data Processing Addendum (DPA).

We collect information about you in several ways when you use our Services:

A. Information You Provide to Us

We collect the Personal Information you voluntarily provide when you sign up for an Account, use the Services, or communicate with us. This includes:

  • Payment Information: Billing details, credit card numbers, or other financial account information used to pay the Fees (processed via third-party providers, but stored securely in accordance with PCI DSS).
  • Identity Verification Data: Documentation, such as a government-issued photo ID or business license, which may be requested to verify ownership or comply with legal obligations (as detailed in Section 3 of the Terms of Service).
  • Support and Communication Data: Information contained in communications with us, such as emails, chat transcripts, and support tickets.

B. Information We Collect from Your Use of the Services

We collect information related to how you use and interact with the Services:

  • Usage and Technical Data: Information about your login times, the features you use, the pages you view, device type, operating system, IP address, and browser information.
  • Transaction and Billing Data: Records of the Subscription Fees, Transaction Fees, and Additional Fees incurred, billing dates, and payment status.
  • Log Data: Server logs that record information about your access and use of the Services, including time stamps and referral sources.
  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to remember your preferences, authenticate your access, and analyze your usage patterns.

3. How We Use Your Information

We use the information we collect from you for the following commercial purposes:

  • To Provide and Maintain the Services: To create and manage your Account, process payments, provide customer support, and ensure the basic functionality and security of the Services.
  • Security and Fraud Prevention: To verify your identity, combat spam, abuse, and prevent fraudulent activity on our platforms, and ensure PCI DSS compliance.
  • Communication: To send you invoices, technical notices, security alerts, and administrative messages related to your Service use.

  • Marketing and Promotion: To communicate with you about products, services, offers, and promotions that we believe may be of interest to you (you can opt-out of marketing communications).
  • Legal Compliance: To meet our legal obligations, including responding to subpoenas, court orders, or government requests, and enforcing our Terms of Service.

4. How We Share Your Information

We share your Personal Information with third parties only in the following circumstances:

  • With Third-Party Service Providers: We use third-party companies (such as payment processors, cloud hosting providers, and technical support partners) to help us operate our business. These providers only receive the minimum information necessary to perform their services for us and are required to protect your information.
  • In Connection with Business Transfers: If Skynet is involved in a merger, acquisition, sale of assets, or bankruptcy, your Personal Information may be transferred as part of that transaction.
  • For Legal Reasons: We may disclose your information if we believe it is necessary to comply with a law, regulation, legal process, or governmental request; to enforce our agreements and policies (including the AUP and TOS); or to protect the security, integrity, and rights of Skynet, our users, or the public.
  • With Your Consent: We may share your information with any other party when we have your explicit consent or direction to do so.

5. Your Rights and Choices

Depending on your jurisdiction, you may have the right to access, correct, or request the deletion of your Personal Information.

  • Access and Correction: You can access and update most of your account information directly within the Skynet administrative console.
  • Opt-Out of Marketing: You can opt out of receiving promotional emails from us by following the unsubscribe instructions provided in those emails.

6. Security

We implement reasonable technical, physical, and administrative security measures to protect your Personal Information from unauthorized access, disclosure, and misuse. However, no security measure is 100% effective, and we cannot guarantee the absolute security of your information.

7. Changes to this Policy

We may update this Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will notify you of material changes by posting the updated Policy and updating the “Last Updated” date. Your continued use of the Services after the effective date of the revised Policy means you accept the revised Policy.
